1. Deposits & Balance Payments
Following confirmation of availability, a provisional place will be held for 7 days. The booking will be confirmed on receipt of a non refundable deposit of 25% of the total course or cruise cost. You will then receive written confirmation of the booking within a further 7 days. The balance must be paid not less than 2 calendar months before the start date of your booking. If the balance is not received, the ISLAND CRUISING CLUB reserve the right to consider the booking cancelled, and all monies will be retained. Bookings made within 2 calendar months of the course or cruise start date must be paid for in full.
2. Cancellation by the Client
A cancellation by the Client may be notified by telephone, but must be confirmed in writing as soon as possible. The date of first information will be considered to be the date of cancellation. For cancellation more than 2 months before the start date, the deposit will be retained and any balance paid returned. For cancellation within 2 months, all payments will be retained and any outstanding balances will still be due. Membership subscription payments are not refundable under any circumstances.
3. Cancellation or Alteration by the ISLAND CRUISING CLUB.
While every effort will be made to operate as described on our web site, the ISLAND CRUISING CLUB reserves the right to cancel a course or cruise should circumstances dictate or we do not have enough numbers to run the course. In this unlikely event a transfer to an acceptable alternative date, location or a full refund will be made.
4. Adverse Weather
In the event of adverse weather preventing a course or cruise being completed, an alternative course or cruise will be arranged, but no refunds given. THE ISLAND CRUISING CLUB is not responsible for members’ transport costs.
5. Course Completion
We cannot guarantee successful completion of a course, be it because of adverse weather or inadequate time for the member to achieve a sufficiently high standard.
6. Price Changes
No changes will be made to the price of a firm booking following receipt of the deposit. However, the ISLAND CRUISING CLUB reserves the right to alter the web site prices.
Where a group booking is made, the person making the booking will be regarded as the ‘group leader’ and, as such, that person will be responsible for payment of all sums due in respect of the group booking.
The group leader is responsible for forwarding all monies to the ISLAND CRUISING CLUB on time, otherwise the places may be transferred to other members and no refunds will be due.
As all correspondence will be forwarded to the group leader, the group leader is responsible for organising their group’s arrival, departure, return of Registration Forms etc.
8. Loss or Accident
The ISLAND CRUISING CLUB cannot be held responsible for any accidents to members, or for loss of or damage to their possessions whilst using any of THE ISLAND CRUISING CLUB’s facilities. The ISLAND CRUISING CLUB, however, have adequate Public Liability and Products Liability Insurance, the maximum in any claim being £5,000,000.
Members are expected to take every reasonable care of craft and equipment owned or operated by the ISLAND CRUISING CLUB. Members must report any loss or damage promptly, in order to make good the loss through insurance, if necessary. Members will be charged for loss or damage resulting from personal negligence.
RYA/NSSA Instructors, NSSA Sailing Masters, RYA Senior Instructors or RYA Coaches do not accept responsibility for any loss, damage or injury suffered by persons and / or their property arising out of or during the course of their activities whilst training and / or coaching and/ or instructing unless such injury loss or damage was caused by, or resulted from negligence or deliberate act.
Pets are not allowed aboard any ISLAND CRUISING CLUB craft.
All persons using THE ISLAND CRUISING CLUB’s boats and facilities must be Full Members and as such must have paid the appropriate subscriptions in full. Only fully paid up members are covered by our insurance. For first time clients, part of the money you pay for your first course or cruise covers the cost of an annual subscription. All members agree to abide to the rules and regulations of the ISLAND CRUISING CLUB membership.
11. Memorandum and Articles of Association
Copies of the ISLAND CRUISING CLUB’s Memorandum and Articles of Association are available from the ISLAND CRUISING CLUB office.
The ISLAND CRUISING CLUB is a company limited by guarantee. As a member, your maximum liability in the case of the ISLAND CRUISING CLUB being wound up is £5.
This contract shall be governed by English Law.
14. Photographs and Social Media
From time to time, we may be taking photographs of the activities at the Club. These photographs are for Club purposes and to use via social media. If you are concerned that recognisable pictures of you or your family should not be used for publicity purposes, please inform us before your arrival.
The Club has the following social media pages e.g. Facebook, WhatsApp, Twitter, Instagram. All members are free to join these pages. If you join one of the Social Media pages, please note that provider of the social media platform(s) has their own privacy policies and that the Club does not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data on the Club social media pages.
THE ISLAND CRUISING CLUB is required to continually monitor the security and confidentiality of members’ personal details. All information provided to the ISLAND CRUISING CLUB on the Island Spirit Registration Form will be used only for the purposes of holding the course or cruise.
